PART A – WEBSITE TERMS OF USE

1. Changes to these terms / the Site

We may amend these terms or update the Site at any time. Please check this page each visit; continued use = acceptance of the latest version.

2. Availability

We do not guarantee the Site (or any content) will always be available or uninterrupted. We may suspend or withdraw the Site for business or technical reasons.

3. Account security

If you create an account, keep your username and password confidential. We may disable any account if, in our opinion, you breach these terms. Notify us immediately of any suspected unauthorised access.

4. Intellectual property

All content on the Site is owned by or licensed to Best Mix Carp. You may print or download extracts for personal use only. No commercial use without our written consent.

5. Linking

You may link to our home page fairly and legally, without implying endorsement. We may withdraw linking permission at any time. We are not responsible for third-party websites linked from our Site.

6. Prohibited use & security

Do not misuse the Site by introducing viruses, attempting unauthorised access, or carrying out denial-of-service attacks. Such acts may be criminal offences under the Computer Misuse Act 1990.

7. Liability

Nothing excludes liability for death, personal injury, or fraud caused by our negligence. Otherwise, the Site is provided “as is”; to the fullest extent permitted by law we exclude all warranties and will not be liable for loss of profit, business interruption or any indirect damage arising from Site use.

8. Applicable law

These Terms of Use are governed by English law. If you are a consumer, courts of England and Wales have non-exclusive jurisdiction; you may also bring proceedings in Scotland or Northern Ireland if resident there. Business users agree to the exclusive jurisdiction of the English courts.

PART B – TERMS & CONDITIONS OF SUPPLY

1. Products & contract formation

1.1 A contract forms only when we accept your order (email confirmation or dispatch, whichever comes first).
1.2 If we cannot accept an order, we will refund any payment taken.

2. Prices & payment

2.1 Prices include UK VAT (where applicable). Delivery costs are shown at checkout.
2.2 We accept major credit/debit cards, PayPal, and any other method shown on the Site. Payment is taken when you place the order.

3. Delivery

3.1 Delivery options and charges are displayed at checkout (Standard or Next-Day UK).
3.2 Times are estimates; delays caused by events outside our control do not constitute breach. Risk passes on delivery to the address provided.

4. Right to cancel (Consumers)

4.1 You may cancel most online purchases within 14 days of receipt (Consumer Contracts Regulations 2013). Email info@bestmixcarp.co.uk to start the process.
4.2 Exclusions: perishable/opened bait, custom or personalised items.
4.3 You must return goods within 14 days of cancellation. We refund within 14 days of receiving goods back (minus any diminished value caused by your handling).

5. Faulty or mis-described goods

Under the Consumer Rights Act 2015 you may be entitled to repair, replacement or refund. Report issues within a reasonable time to info@bestmixcarp.co.uk; include order number and photos where possible.

6. Limitation of liability (Supply)

Nothing limits liability for death/personal injury due to negligence, fraud, or statutory consumer rights. Otherwise our total liability for any order shall not exceed the price paid for that order. We are not liable for indirect or consequential losses or for business losses if you purchase as a consumer.

7. Events outside our control

We are not responsible for failure or delay caused by events beyond reasonable control (e.g. strikes, extreme weather). We will notify you and provide a new delivery date or offer cancellation with refund.

8. Data protection

We process your personal data in accordance with our Privacy Policy (GDPR compliant). By ordering, you consent to such processing.

9. Transfer of rights

We may transfer our rights/obligations to another organisation. You may transfer your rights only with our written consent.

10. Severability

If any part of these terms is held unlawful, the remaining provisions remain in full force.
